The Code

The Moral Framework of the Decentralist Republic

Roy W. Gurner · December 31, 2025 · 6 min read

Laws govern actions. The Code governs principles. Nineteen papers describe a structure. This one says what the structure is for.

The First Principle:

Believe what you want. Worship how you want. Say what you want. Think what you want.

The only limit: do not violate another person’s rights.

Your freedom ends where another’s begins. That is the whole code. Everything below is that sentence applied.

Speech

All speech is protected.

Words are not violence. Offense is not harm. Disagreement is not assault.

You can say anything, print anything, broadcast anything. Others answer with their own speech, never with force.

What this means:

  • No hate speech laws; the category does not exist in law
  • No government misinformation boards, because someone has to decide what is true and it should never be the state
  • No government regulation of speech of any kind
  • Private platforms set their own rules; it is their property

The answer to bad speech is more speech.

Arms

An armed, trained citizenry is the norm.

The Militia Act of 1792 required every able-bodied citizen to own a musket. The Founders did not merely permit an armed population; they assumed one.

Why:

  • The Second Amendment means what it says
  • An armed population is very hard to tyrannize
  • Self-defense is a natural right
  • Police cannot be everywhere, and should not be

Exceptions:

  • Mental illness, adjudicated by a court, not self-reported
  • Felony conviction for a violent crime
  • An active restraining order

Training:

  • Firearms safety taught in schools
  • Marksmanship as ordinary as driver’s education
  • Militia readiness, not militia membership

Life

We do not kill innocents.

The Decentralist position is that life begins at conception, and that an innocent life is protected by the same first principle as every other right.

The exception: the life of the mother, in a genuine medical emergency.

Rape and incest are tragedies for the mother. They are not the child’s doing. Adoption and support exist, and a Decentralist community funds both through the tithe.

We know this is the point on which many reasonable people disagree with us, because they disagree about when a life begins. We state our reasoning so it can be argued with: if there are two bodies, there are two sets of rights.

Military Service

Service is honored, and service has privileges.

Citizens who complete military service with an honorable discharge may opt out of legislative sortition. They served once; they are not compelled to serve twice. They may still volunteer if selected.

The Presidency

Not everyone can lead a continent.

The President of the Continental Union commands the largest military on earth and coordinates fifty or more State CEOs. The office needs someone who has already run something enormous.

Qualifications, one of:

  1. Flag or general officer rank (O-8 or above). You have commanded thousands and you understand war, logistics, and strategy.
  2. Chief executive of a very large organization. You have run something with the budget and headcount of a mid-sized country.

The Framers set only age, residency, and birth as qualifications, and deliberately rejected property and rank tests. We depart from them here on purpose, and we say so: the office has grown far beyond what they designed, and the selection filter should grow with it.

Citizenship and service:

Native-born citizens and naturalized citizens may serve in any office except the Presidency, which follows the existing natural-born requirement. Loyalty is proven by conduct and by the oath, not by ancestry. Hamilton was born in the Caribbean and built the Treasury.

The uniform:

Military dress and grooming standards are set by the services for operational reasons: safety, equipment fit, unit cohesion. Exceptions are granted the way they are today, by the services, for medical necessity or where they cost nothing operationally. Article VI bars any religious test for office, and the Decentralist Republic honors that.

Justice

Three tiers. Simple. Clear. Final, once the process is complete.

Tier 1: Restitution (petty crime)

Theft, vandalism, minor fraud, first-offense nonviolent crime.

The sentence: repay what you took, plus a penalty, plus the victim’s time.

  • Stole $500? Pay $500, plus $500, plus the victim’s lost wages for court
  • Cannot pay? Work it off
  • No prison for petty crime; prison costs roughly $50,000 per inmate per year and makes petty offenders into professionals

The goal: make the victim whole. Not warehouse the offender.

Tier 2: Exile and forfeiture (serious crime, including corruption)

Major theft, serious fraud, repeat offenders, and every form of public corruption: bribery, embezzlement, self-dealing, selling a vote.

The sentence:

  • Permanent exile from the Continental Union
  • All assets liquidated to compensate victims and the treasury
  • A lifetime bar from any office, contract, or employment with government
  • Return is a Tier 3 offense

Why exile and not death for corruption. Because “corruption” is defined by whoever holds power, and a capital charge with a political definition is how republics are turned into dictatorships. Rome’s treason law, Stalin’s purges, and modern anti-corruption campaigns that execute officials all run on the same mechanism. A death penalty for corruption also does the opposite of what it intends: juries refuse to convict, so punishment becomes rare, and an official who faces death for leaving office never leaves. Exile with total forfeiture is cheaper, more certain, removes the person completely, and takes the deal every corrupt official will take. Certainty deters. Severity, past a point, only reduces certainty.

Tier 3: Death (the predators)

Some acts forfeit the right to live among us.

Capital crimes:

Crime Rationale
Treason Aiding a foreign enemy, proven to the Article III standard: two witnesses to the same overt act, or confession in open court
Mass murder Multiple lives taken deliberately
Murder of a child Children are the one class of victim who cannot defend themselves at all
Human trafficking Selling human beings
Narco-trafficking at cartel scale Tens of thousands of dead a year is a war, and it is prosecuted like one
Cartel leadership Enemy combatant status
Terrorism Deliberate mass violence against civilians
Rape with aggravating violence, or of a child The victim’s life is taken in every way but one

Illegal entry is not on this list. It is a Tier 1 or Tier 2 offense: removal, and exile for repeat entry. Death is reserved for those who destroy lives, not for those who cross a line.

Process:

  • Conviction requires overwhelming evidence: physical evidence, recording, multiple witnesses, or confession
  • One mandatory appeal, heard within one year, on the record
  • Execution within 90 days of a failed appeal
  • No decade-long delays, and no execution without the appeal

Public accountability:

When the state takes a life, it does so in the open. The conviction, the evidence, and the sentence are on the public record. The execution is witnessed by citizens and by the press. No hidden rooms and no sanitized language. It is an execution, and the state owns it.

Method: firing squad or hanging. Both are fast and honest about what they are. Lethal injection pretends to be medicine; we do not pretend.

The Logic

Why this structure?

Because deterrence requires certainty, and the current system offers none. Criminals expect not to be caught; if caught, to plead down; if convicted, to serve a fraction; if imprisoned, to be released early.

Under the Decentralist system: if you do X, Y follows. Quickly, publicly, and every time.

For most crimes, that means restitution. For serious crime and for corruption, it means exile and losing everything. For the predators, it means death, after one honest appeal.

We do not kill innocents. The unborn, children, and law-abiding citizens.

We do kill the guilty, when the guilt is certain and the act is monstrous.

Protect the innocent. Remove the predators. Argue about everything in between, on the record, as the Founders did.
